Terms of Service These Terms of Service (hereinafter referred to as the "Terms") set forth the terms and conditions for the use of the services (hereinafter referred to as the "Services") provided by BlogStar (hereinafter referred to as the "Company") on this website. Registered users (hereinafter referred to as "Users") are requested to use the Services in accordance with these Terms. Article 1 (Applicability) 1. These Terms shall apply to all relationships between the User and the Company regarding the use of the Services. 2. In addition to these Terms, the Company may make various rules and regulations regarding the use of the Services (hereinafter referred to as "Individual Regulations"). Regardless of their name, these Individual Regulations shall constitute a part of these Terms. 3. Article 2 (Registration) 1. In the Services, registration shall be completed when a prospective registrant applies for registration by the method specified by the Company upon agreeing to these Terms, and the Company notifies the prospective registrant of its approval. 2. The Company may not approve the application for registration if it determines that the applicant has any of the following reasons, and shall not be obliged to disclose the reason. Users shall manage their User IDs and passwords for the Services properly at their own responsibility. 2. Users may not transfer or lend their User IDs and passwords to a third party, or share them with a third party under any circumstances. If the combination of User ID and password matches the registered information and a login is made, the Company will consider it to be use by the User who has registered that User ID. 3. The Company shall not be liable for any damages caused by the use of User IDs and passwords by third parties, unless there is intentional or gross negligence on the part of the Company. Article 4 (Usage Fees and Payment Methods) 1. Users shall pay the usage fees separately determined by the Company and displayed on this website as consideration for the paid portion of the Services, by the method specified by the Company. 2. If the User delays payment of the usage fees, the User shall pay delay damages at a rate of 14.6% per annum. Article 5 (Prohibited Acts) Users must not perform the following acts when using the Services. (1) Acts that violate laws and regulations or public order and morals (2) Acts related to criminal acts (3) Acts that destroy or interfere with the functions of the Company's, other users of the Services, or third parties' servers or networks (4) Acts that may interfere with the operation of the Company's services (5) Acts of collecting or accumulating personal information, etc. regarding other users (6) Acts of unauthorized access or attempting to do so (7) Acts of impersonating other users (8) Acts of directly or indirectly providing benefits to antisocial forces in connection with the Company's services (9) Acts that infringe on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Company, other users of the Services, or third parties (10) Acts of posting or transmitting content on the Services that includes or that the Company determines to include the following expressions: - Excessively violent expressions - Explicit sexual expressions - Expressions that lead to discrimination based on race, nationality, creed, gender, social status, family origin, etc. - Expressions that induce or encourage suicide, self-harm, or drug abuse - Other expressions that include antisocial content and cause discomfort to others (11) Acts that are intended for or that the Company determines to be intended for the following purposes: - Sales, publicity, advertising, solicitation, or other profit-oriented acts (excluding those approved by the Company) - Acts for the purpose of sexual conduct or obscene acts - Acts for the purpose of meeting or dating unrelated persons of the opposite sex - Acts for the purpose of harassing or slandering other users - Acts for the purpose of causing disadvantage, damage, or discomfort to the Company, other users of the Services, or third parties - Other acts of using the Services for purposes different from the intended use of the Services (12) Solicitation for religious activities or religious organizations (13) Other acts that the Company determines to be inappropriate Article 6 (Suspension of Provision of the Services, etc.) 1. The Company may suspend or interrupt the provision of all or part of the Services without prior notice to the User if it determines that any of the following reasons exist. (1) When performing maintenance checks or updates on the computer system for the Services (2) When provision of the Services becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters (3) When computers or communication lines, etc. stop due to an accident (4) In other cases where the Company determines that provision of the Services is difficult 2. The Company shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Services. Article 7 (Copyright) 1. Users may use the Services and post or upload information such as text, images, and videos only regarding information for which they own the necessary intellectual property rights such as copyrights or for which they have obtained the permission of the necessary rights holders. 2. Copyrights regarding text, images, videos, etc. posted or uploaded by Users using the Services shall be reserved to such Users or other existing rights holders. However, the Company may use text, images, videos, etc. posted or uploaded using the Services to the extent necessary for improving the Services, improving quality, correcting deficiencies, etc., and for publicizing and advertising the Services, and Users shall not exercise their moral rights regarding this use. 3. Except as provided in the main text of the preceding paragraph, all copyrights and other intellectual property rights regarding the Services and all information related to the Services belong to the Company or rights holders who have granted licenses to the Company, and Users strictly prohibited from reproducing, transferring, lending, translating, modifying, reprinting, public transmission (including making transmittable), transmitting, distributing, publishing, using for business, etc. without permission. Article 8 (Restriction of Use and Deregistration) 1. The Company may delete posted data, restrict the User from using all or part of the Services, or deregister the User as a registered user without prior notice if the User falls under any of the following. (1) If any provision of these Terms is violated (2) If it is found that there is a falsehood in the registered matters (3) If the credit card reported by the User as a payment method has been suspended (4) If there is a default in payment of fees, etc. (5) If there is no response for a certain period to contact from the Company (6) If the Services have not been used for a certain period since the last use (7) In other cases where the Company determines that use of the Services is not appropriate 2. If the User falls under any of the preceding items, the User naturally loses the benefit of time for all debts owed to the Company, and must immediately pay all debts borne at that time in a lump sum. 3. The Company shall not be liable for any damages caused to the User by acts performed by the Company based on this Article. Article 9 (Withdrawal) The Services currently do not provide a withdrawal function for Users. If a User wishes to stop using the Services, they shall handle it by simply ceasing to use the Services. Article 10 (Disclaimer of Warranty and Exemption of Liability) 1. The Company does not explicitly or implicitly warrant that the Services are free from de facto or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors and bugs, infringement of rights, etc.). 2. The Company shall not be liable for any damages caused to the User resulting from the Services, except in cases of intentional or gross negligence by the Company. However, if the contract between the Company and the User regarding the Services (including these Terms) acts as a consumer contract defined in the Consumer Contract Act, this exemption provision shall not apply. 3. Even in the case provided in the proviso of the preceding paragraph, the Company shall not be liable for any damages arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damages) among damages caused to the User by default or tort due to the Company's negligence (excluding gross negligence). In addition, compensation for damages caused to the User by default or tort due to the Company's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month in which such damages occurred. 4. The Company shall not be liable for any transactions, communications, or disputes, etc. that occur between the User and other users or third parties regarding the Services. Article 11 (Changes to Service Content, etc.) The Company may change, add, or abolish the content of the Services with prior notice to the User, and the User shall consent to this. Article 12 (Changes to Terms of Service) 1. The Company may change these Terms without requiring the individual consent of the User in the following cases: (1) When the change to these Terms is compatible with the general interests of the Users. (2) When the change to these Terms is not contrary to the purpose of the Service usage contract, and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances pertaining to the change. 2. The Company will notify Users in advance of the fact that these Terms will be changed, the content of these Terms after the change, and the effective date thereof, when changing these Terms pursuant to the preceding paragraph. Article 13 (Handling of Personal Information) The Company shall properly handle personal information acquired through the use of the Services in accordance with the Company's "Privacy Policy". Article 14 (Notification or Communication) Notification or communication between the User and the Company shall be made by the method specified by the Company. Unless the User submits a change notification in accordance with the method separately specified by the Company, the Company will consider the currently registered contact information to be valid and will notify or contact said contact information, and these will be deemed to have reached the User at the time of transmission. Article 15 (Prohibition of Assignment of Rights and Obligations) Users may not assign their status under the usage contract or rights or obligations based on these Terms to a third party or provide them as collateral without the prior written consent of the Company. Article 16 (Governing Law and Jurisdiction) 1. In interpreting these Terms, Japanese law shall be the governing law. 2. In the event of a dispute regarding the Services, the court having jurisdiction over the location of the Company's head office shall be the detailed agreement jurisdiction. End
